1. ACCEPTANCE OF TERMS
By accessing or using Humanize Mastering (humanizemastering.com), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.
2. DESCRIPTION OF SERVICE
Humanize Mastering provides browser-based audio mastering tools, including hardware-emulated mastering chains, audio restoration, a preset marketplace, and related services. All audio processing occurs locally in your web browser. No audio files are uploaded to or stored on our servers.
3. ACCOUNTS & REGISTRATION
You must create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials. You must provide accurate and complete information when creating your account. You may not share your account with others or create multiple accounts. We reserve the right to suspend or terminate accounts that violate these terms.
4. SUBSCRIPTION PLANS & BILLING
4.1 Plans
FREE: $0/month — 3 watermarked MP3 preview masters per month, 60-second preview cap, 1 Human ID processing per month. Free exports are for testing and demo evaluation.
CREATOR: $14.99/month or $149.98/year — Unlimited mastering and processing, no-watermark release-ready exports, high-quality WAV and MP3 export access, professional audio enhancement, and Human ID™ authenticity encoding included free.
PRO ENGINEER: $34.99/month or $299.98/year — Advanced professional mastering tools, 48,000 Hz / 24-bit export options in WAV, FLAC, AIFF, and MP3, batch processing, Human ID™ authenticity encoding, priority workflow, marketplace selling tools, and 70% creator commission on eligible preset sales.
4.1A Free Preview Watermark
Free plan exports may include an audible preview watermark, filename/metadata preview labeling, and a time limit. Creator and PRO plans remove these free-preview restrictions unless otherwise stated.
4.2 Billing
Subscriptions are billed in advance on a monthly or annual basis through Stripe. You authorize us to charge your payment method for the subscription fee. Subscriptions automatically renew unless cancelled before the renewal date.
4.3 Refunds
Subscription fees are non-refundable except as required by applicable law. If you cancel your subscription, you retain access to your plan's features until the end of the current billing period.
5. PRESET MARKETPLACE
5.1 Selling Presets
Creators and PRO Engineers may sell mastering presets through our marketplace. By listing a preset for sale, you represent that you are the original creator of the preset and have the right to sell it. Preset files are encrypted and license-locked to the buyer's account.
5.2 Revenue Share
Community Creators receive 70% of the sale price. PRO Engineers receive 70% of the sale price. Humanize Mastering retains 30% as a platform fee. Payouts are processed through Stripe Connect.
5.3 Community Creator Activation
Community Creators pay a one-time $4.99 activation fee to access the marketplace. Community Creators are limited to 10 active listings. Preset pricing for Community Creators ranges from $1.99 to $6.99.
5.4 PRO Engineer Status
PRO Engineer status is granted after verification of professional credentials including discography and professional references. PRO Engineers have no activation fee and no listing caps. PRO Engineer preset pricing ranges from $14.99 to $29.99 for singles and $39.99 to $79.99 for bundles.
5.5 Purchases
All preset purchases are final. Purchased presets are licensed to the buyer's account and cannot be transferred, shared, or resold. Attempting to circumvent preset encryption or license protection is a violation of these terms.
6. INTELLECTUAL PROPERTY
6.1 Our Property
Humanize Mastering, Human ID™, PRISM EQ™, and all associated branding, logos, software, code, algorithms, and documentation are the exclusive property of Humanize Mastering. Human ID™ technology is patent-pending. You may not reverse engineer, decompile, disassemble, or attempt to derive the source code of any proprietary technology, including but not limited to the Human ID™ engine and mastering algorithms.
6.2 Your Content
You retain all rights to your audio files. We do not claim any ownership over audio you process through our service. Presets you create and list on the marketplace remain your intellectual property, subject to the license granted to buyers upon purchase.
7. PROHIBITED CONDUCT
You agree not to use our services to process, distribute, or create content that is illegal, harmful, or infringes on the rights of others; attempt to access, reverse engineer, or tamper with our proprietary technology, source code, or security measures; share, distribute, or resell purchased presets or circumvent preset encryption; use automated tools, bots, or scripts to access our services; impersonate another person or misrepresent your identity or credentials; interfere with or disrupt the operation of our services; or violate any applicable laws or regulations.
8. APP PROTECTION
Our application includes security measures to protect proprietary technology. These measures include restrictions on developer tools, text selection, copying, printing, and right-clicking within the application. By using our service, you acknowledge and accept these protections.
9. DISCLAIMER OF WARRANTIES
Our services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will be uninterrupted, error-free, or completely secure.
10. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Humanize Mastering shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of our services, whether based on warranty, contract, tort, or any other legal theory.
Our total liability for any claims arising from your use of our services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
11. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Humanize Mastering and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of our services, your violation of these terms, or your infringement of any third-party rights.
12. TERMINATION
We may suspend or terminate your account at any time for violation of these terms, with or without notice. Upon termination, your right to use our services ceases immediately. Provisions that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and indemnification.
13. GOVERNING LAW
These Terms of Service are governed by and construed in accordance with the laws of the State of Wisconsin, United States, without regard to conflict of law principles. Any disputes arising from these terms shall be resolved exclusively in the state or federal courts located in Milwaukee County, Wisconsin.
14. DISPUTE RESOLUTION
Before filing any legal claim, you agree to attempt to resolve the dispute informally by contacting us at legal@humanizemastering.com. If the dispute is not resolved within thirty (30) days, either party may proceed with formal legal action.
15. MODIFICATIONS
We reserve the right to modify these Terms of Service at any time. Material changes will be communicated by posting the revised terms on our website with an updated "Last Updated" date. Your continued use of our services after such modifications constitutes acceptance of the updated terms.
16. SEVERABILITY
If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17. ENTIRE AGREEMENT
These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Humanize Mastering regarding your use of our services and supersede all prior agreements and understandings.
